The short answer
An announcement can accurately name the outer horizon of a project while omitting the steps needed to reach it. Westports’ February 2024 release summarised an extension to 2082. Its detailed year-end filing also described a 2070 stage and a land-acquisition and transfer condition. The useful reading question is how those statements fit together. This guide compares the issuer’s own records; it does not replace the executed agreement or determine a present concession entitlement.
Compare the records
A record, its scope and the inference
Use the detail that answers the question, then preserve the condition attached to it.
| Record or example | Evidence supplied | Supported inference |
|---|---|---|
| February 2024 release | A concise 58-year / 2082 summary. | Useful orientation; it does not reproduce every condition. |
| Note 20(a) and (f) | 2070 stage, land deadline and expressly conditional projected spending. | Carry the qualification into any summary. |
| Fictional files A–C | Different evidence of acquisition and transfer. | Test the event and deadline, not just a date printed on a cover. |
Chronology
A timeline of the turning points
Supplemental agreement
The operating subsidiary entered the agreement with the government and Port Klang Authority.
Reporting date
The year-end announcement describes the proposed expansion and conditions.
Results release
The shorter release summarises a 58-year extension to 2082.
New term begins in the filing
A future contractual date at the time of the announcement; not evidence of completed new terminals.
Begin with who entered the agreement
Note 20 identifies Westports Malaysia Sdn Bhd, the operating subsidiary, as the party entering the Third Supplemental Privatisation Agreement with the Government of Malaysia and Port Klang Authority on 8 December 2023. It concerns proposed container terminals 10 to 17. This identifies an institutional transaction, not a personal extension granted to the founder. G. Gnanalingam had died earlier that year. The future timetable belongs to the continuing company and its public counterparts.
Read the condition beside the headline horizon
The release describes a 58-year extension to 2082. In the detailed filing, paragraph (a) first specifies 31 August 2070 for CT 10 to CT 13. It then links extension to 31 August 2082 to completion of acquisition of a third parcel of underwater land from the Selangor State Government and its transfer to PKA by 31 August 2045 for CT 14 to CT 17. Paragraph (b) compresses the new term into an overall 2024–2082 description. Reading it alone would lose the qualification supplied immediately above it.
The responsible conclusion is therefore conditional: 2082 is the stated outer horizon, with a specified land milestone in this disclosure. The original executed agreement could contain definitions and further terms not reproduced in the summary. A reader should preserve the disclosed condition rather than claiming the short release proves an unconditional right.
The cost figures also refer to different scopes
The same note reports roughly RM 12.6 billion of initial expansion expenditure and RM 39.6 billion of projected expenditure over 58 years, subject to the condition in paragraph (a). The larger number includes replacement expenditure for existing CT 1 to CT 9 and for the proposed expansion. Adding the two would count the initial expansion component twice. Neither figure is the founder’s personal investment receipt, a completed terminal, or a guarantee that the forecast spending occurred. The purpose of reading the note is to retain its project scope and time horizon.

Original exercise: classify three project files
Use three fictional files for an unrelated concession with exactly the land condition stated above. File A contains a completed acquisition and transfer recorded on 30 June 2044. File B contains completion on 1 September 2045. File C contains a purchase negotiation but no proof of acquisition or transfer. For each file, decide whether the supplied evidence meets the stated deadline condition. Then write a one-sentence summary that can mention 2082 without presenting a conditional date as an accomplished entitlement. Do not invent a waiver, amendment or retrospective cure.

Reference answer: a date needs an event and evidence
A meets this particular deadline condition because both required steps are recorded before 31 August 2045. B does not meet it on the supplied facts because completion is later. C is unproven: negotiation is not completed acquisition and transfer. These classifications do not decide every legal issue in a real agreement. A suitable summary is: the filing describes an outer concession horizon of 2082, subject to the specified land acquisition and transfer milestone; the available file must establish whether that condition was fulfilled.

A reusable reading habit
Separate the signing date, effective term, construction programme and conditional extension. An agreement can be signed before its new term starts, and a concession date does not itself show when a terminal opened. Here, comparing a short release with a detailed note reveals precisely what the headline leaves out. The exercise trains the reader to ask for evidence of the required event, rather than to turn an issuer’s prospective timetable into a statement about present operating capacity or legal certainty.

Common questions
- Was the executed agreement read?
- No. This comparison uses the issuer’s detailed exchange announcement and results release.
- Does a concession end date prove that new terminals opened?
- No. A contractual horizon and a completed operating facility are different events.
