Law, public office and constitutional rights

Jose Wright Diokno trained in accounting and law, topping both the certified public accountant examination and, with Jovito Salonga, the 1944 bar examination. A prominent legal career brought him into President Diosdado Macapagal’s cabinet as justice secretary in 1962.

Diokno entered the Senate in 1963. He argued for economic nationalism, civil liberties and limits on executive power, positions that increasingly placed him against Ferdinand Marcos as political repression expanded before martial law.

Detention and the creation of FLAG

When martial law was imposed in September 1972, Diokno was arrested and held without charge for nearly two years. Part of that detention was spent in solitary confinement at Fort Magsaysay alongside Benigno Aquino Jr.

After his release, Diokno helped establish the Free Legal Assistance Group. FLAG lawyers represented political prisoners, workers, farmers and other people whose cases tested whether legal rights could still be asserted under authoritarian government.

Human rights as a democratic foundation

Diokno continued to document abuses, speak publicly and organise civil-liberties work through the final years of the Marcos regime. After People Power, President Corazon Aquino appointed him to lead a new presidential human rights body and the government panel in peace talks with the National Democratic Front.

He died in 1987, one day after his sixty-fifth birthday. His legacy rests not only on opposition to one government but on the institutions and legal practice he built for defending rights beyond that political moment.
